Bank Loan Default What Happens After Missing EMI Payments? & Across India

Missed bank loan EMIs? Learn about overdue charges, credit reporting, NPA classification, recovery notices, SARFAESI action and settlement options in India.

Bank Loan Default What Happens After Missing EMI Payments?

Missing one Equated Monthly Instalment (EMI) doesn’t seem so bad. With two EMIs missed you begin to get harassing calls, notices and late payment fees along with stress and anxiety. Once you miss your third EMI, many borrowers fear getting fired from their job, their years of good credit being tarnished or even their home being taken away.

A loan is typically classified as a default when you fail to make an EMI payment by the due date. You will be charged late fees as per your loan agreement. Your lender will report your late payment to credit bureaus and initiate recovery calls. If the EMI continues to be overdue, your lender can mark your account as stressed, and ultimately classify your loan as a non-performing asset (NPA), according to RBI norms.

But lenders can’t suddenly arrest you for missing an EMI, seize your property, or behave rudely during the recovery process. Loan default is generally civil and contractual issue. For criminal prosecution to come into the picture, there will have to be a separate offence committed – such as cheating, misappropriation or Section 138 of the Negotiable Instruments Act, 18 81, in the event of a cheque bounce.

Every loan default situation is different, and so is its resolution. Whether you have a secured loan or not, how long your loan has been overdue, and whether your financial hardship is temporary will play a role in what you do next. BK Singh, legal advisor at Loan Settlement Agency suggests that borrowers read through their loan agreement and understand their repayment capacity before accepting any verbal settlement offer.

Loan Settlement Agency has put together some resources for borrowers looking to understand their options before contacting their lender. This article will walk you through the process that follows after missing out on EMI payments, laws that govern your lender and you, and explain the difference between loan regularisation, restructuring and settlement.

Why Loan Default Matters Across India in 2026

Digitisation of lending and automated credit reporting mean that repayment delays are visible much faster. Automatic calls to Delhi, Noida, Mumbai, Jaipur or Bengaluru numbers can happen within hours of a debit bounce, followed quickly by calls from collection teams. If you're a salaried borrower, future employment or your ability to borrow again may be called into question.

Business owners have more on the line. often there are multiple facilities bundled together with personal guarantees and pledged commercial assets like buildings or equipment. Your family can be impacted too if your spouse, partner or parent has co-signed as a borrower or guarantor. By acting sooner rather than later, BK Singh's Loan Settlement Agency can help you figure out if you are facing a temporary cash-flow issue or a default situation where a written repayment proposal, request for restructuring or settlement evaluation will be required.

What Is a Bank Loan Default?

Bank loan default occurs when a debtor fails to meet a scheduled payment as specified in the terms of the loan agreement. It can be missing a single EMI payment, or even consecutive no payment or breach of financial covenant or unpaid recalled amount. There is a difference between default and NPA. While default is the inability of borrowers to repay the loan, NPA is when the lender declares the asset as NPA when certain criteria is met. One who has defaulted on even one EMI should not claim the loan as cleared, written off or fully defaulted. Advocate BK Singh from Loan Settlement Agency generally considers total number of overdue days, bank statement and type of loan before assessing its status.

Who Needs This Guidance?

If you’re a salaried employee who got fired, a student who started EMI’ing your education-loan, a family affected by medical expenses or a self-employed individual with irregular cash flows, read on. Documents and Evidence Checklist

Ideally we would want the following in your file:-

  • Loan sanction advice letter, loan agreement and repayment details
  • Recent statement of account and outstandings
  • Bank statements where previous EMIs have been deducted
  • Salary slips, resignation notice or business cash flows
  • Medical bills/receipts or other evidence of hardship claims
  • Emails, text messages, WhatsApp conversations and demand notices
  • Recovery-agent name/id, call records and recordings (if legally recorded)
  • Co-applicant, Guarantor and Margin documents
  • Any restructuring, settlement or waiver applications.
  • Acknowledgements, lender memos and previous closure letters.

With all these records neatly compiled and in order, BK Singh from Loan Settlement Agency can identify mistakes in charging, missing payments or inconsistencies without prejudicing the borrower’s right to reply.

When Should You Consult a Lawyer?

Documents Must Be Reviewed Quickly If you receive a loan recall notice, SARFAESI demand letter, possession notice, arbitration notice, Lok Adalat notice, lawsuit summons or notice sent to guarantor. If the outstanding balance they say you owe is incorrect, they skipped a payment on your statement, recovery agents are contacting coworkers or family members, or if your lender will not accept your settlement proposal in writing.

Consult with Advocate BK Singh at Loan Settlement Agency before sending money for a settlement offer that is significantly larger than what you can afford if there are unclear waiver, closure or credit-reporting language hidden in the offer. In most cases it is easier to review documents in advance and avoid having to renege on a verbal agreement.

Frequently Asked Questions

1. What happens if I miss one EMI?

Lender can send reminders or levy permitted fees as per loan documents and report the delinquency via applicable credit-reporting channel. Making payment promptly thereafter may prevent future delinquency but will not automatically wipe out an already reported missed-payment entry.

2. Can Police arrest me if I default on personal loan?

Default is usually a civil and contractual matter. You will not be sent to jail for failure to repay an EMI or Personal Loan. However, Police may file a separate criminal case against you for fraud, cheque bounce, using false documents etc.

3. What time does loan become NPA?

As per applicable prudential norms, a term loan account is normally considered as NPA when both principal or interest payment due is more than 90 days overdue. Please refer to product specific guidelines for any variations or permitted carve outs.

4. Will bank attach my property if I miss one EMI?

No. For a bona fide missed payment. However, If the loan is secured and qualifying, lender can initiate the recovery process as per loan documents and applicable SARFAESI law by issuing a statutory notice before taking enforcement action.

5. Can I ask for reduced EMI instead of settling the loan?

Yes. You can ask lender to restructure your loan, extend tenure or modify repayment terms. All decisions are at the sole discretion of the lender and may depend on their policies, your repayment capacity, payment history, credit score and account status.

6. If I settle my account, will it be removed from CIBIL history?

Not exactly. Your loan may show as “settled” on your credit report instead of “closed” or “paid in full”. Please refer to Clearing your name with CIBIL if there’s any incorrect information on your CIBIL report.

7. Can bank recovery agents call at my office?

Yes. But, the recovery agent cannot harass you at your workplace or use abusive language. Humiliating you in public or threatening you is unethical. Keep a record of incidents and inform the lender if the recovery agent breaks any law.

8. Will guarantor be liable if I fail to pay?

Yes. Lender can usually exercise remedies against the guarantor as agreed in the guarantee agreement. As per Indian Contract Act, Section 128, the liability of the guarantor is co-extensive with that of the principal debtor unless otherwise agreed as part of the contract.

9. Do I pay EMI if bank has called me to settle?

Be cautious of verbal settlement offers. Always ask for a written communication from the lender stating the account number, amount to be paid, payment due date and terms of account closure. BK Singh from Loan Settlement Agency will be glad to review the legal documents for you if any clause is unclear.

10. Can all loans from banks be settled?

No. Settlement depends on lender’s policies, how far the account is in default, recoverability of loan amount, proof of financial difficulty and availability of cash. You can always negotiate but can’t demand lender to settle the loan for a predetermined amount.

Conclusion

Defaulting on EMI payments can result in bank loan default and affect your credit score, finances, your family's peace of mind and secured assets. Doing nothing will only allow the problem to become more expensive and procedurally complex. Understand where your account stands. Write it down. Negotiate with your lender based on your repayment ability. Documents related to your past due EMIs, lender notices, recovery conduct and possible options can be reviewed by BK Singh who can guide you about loan settlement.
