Yes. Divorce petitions can be filed where the marriage was solemnised in India, or where either spouse is domiciled in India. Service outside India is governed by the CPC provisions on service of summons outside India. The Supreme Court has laid down guidelines for waiver of cooling-off period.
Can revision be filed after maintenance is granted? Yes. An order of maintenance can be modified on a change in the circumstances of the parties - such as increase in payer's income, or decrease in recipient's need, recipient's remarriage, change in child's needs etc. An application for modification has to be filed before the court that passed the original maintenance order.
A joint petition for divorce by mutual consent can be filed under the Special Marriage Act 1954 after one year of marriage and separation. The Hindu Succession Act is an act governing inheritance and succession among Hindus. Dissolution of marriage does not automatically extinguish inheritance rights - a divorced spouse is not considered an heir under succession laws. No, a decree of divorce once granted cannot be overturned unless the divorce was obtained by fraud or misrepresentation, or there was concealment of material facts from the court. Further, if there is a procedural defect in how the order was passed, it can also be challenged. Mutual consent divorces can be withdrawn before the second motion.

An FIR is a document prepared by the police when they receive information about the commission of a cognizable offence. Anyone who has information about the commission of a cognizable offence can file an FIR. It does not have to be the victim. The police are bound to register the FIR and cannot refuse to register a complaint regarding cognizable offence. However, if police refuse FIR, complaint can be filed before Magistrate.
A Zero FIR is an FIR registered at any police station irrespective of the area where the offence was committed or the police station having jurisdiction over the offence. It is given a number 0 and later sent to the concerned police station to investigate the crime. Zero FIRs have been introduced in order to eliminate delays based on jurisdiction.
An FIR is lodged to set the investigation process in motion when an offence has been committed. Police investigation into the offence commences once an FIR is registered. A chargesheet (Final report under Section 193 BNSS) is filed by police after completion of their investigation, laying down the charges against the accused, evidence collected, and naming the accused persons. While filing the chargesheet is what actually brings the case to court for trial.
Discharge is granted before trial when the court considers the chargesheet and materials presented by the prosecution and finds that there are no grounds to proceed with the accused even on the face of it. An acquittal is given when the matter goes to trial, and judgment is issued by the court finding that the accused is not guilty of the crime on the basis of the evidence.
Yes, the police can arrest a person without a warrant if the offence is a cognizable offence. Non-cognizable offences are those offenses that require a Magistrate’s approval to make an arrest. Section 35 BNSS (previously Section 41 CrPC) is a crucial provision that lists checks on police powers of arrest without warrant.
If the police want to keep the accused in their custody for questioning, they can do so through police remand for up to 15 days in serious offenses. Judicial remand refers to jail custody i.e. the accused will no longer be in police custody but in jail, monitored by the courts. Judicial remand is the custody after chargesheet has been filed.
A confession made to the police officials, whether in custody or not is inadmissible against the accused under section 25 of Indian Evidence Act, 1872 (now Bharatiya Sakshya Adhiniyam). However, if a confession is made before a Magistrate under section 183 BNSS, it can be admissible provided it is made voluntarily. If made to some other person e.g friend, spouse, parent then the statement may or may not be admissible.
A section 183 BNSS statement (earlier 164 CrPC) is a statement made to the Magistrate by a witness or the accused. The Magistrate is obligated to explain to the person making the statement that they are not bound to make a statement and that they make the statement on their own free will. Statements made under this section are given credence over police station statements and are relied on by courts.
A witness in serious criminal cases is entitled to protection like change in identity and shelter through witness protection programs. Courts can also order sensitive testimony to be recorded in camera i.e. in private, through a screen, or video conference. Application can be made to the courts or appropriate government agency.
Criminal conspiracy under Section 61 BNS occurs when two or more persons agree to do or cause to do an illegal act, or an legal act by illegal means. Conspiracy is unique from most offences in that the agreement is the offence. It need not be proved that the actual offence was committed. Charges of criminal conspiracy are often levied alongside substantive offences.
Murder requires intention to cause death, intention to cause bodily injury which is likely to cause death, knowledge that the act is likely to cause death, and imminently dangerous act regardless of knowledge. These form the four clauses which constitute murder. If any of the above requirements are not fulfilled but still there's intention to cause death or cause bodily injury, then it becomes Culpable homicide. However this distinction is decided on facts of each case.
A person can be convicted of abetment if they instigate, conspire or intentionally aid someone to commit an offence. Even if the principal offender is unknown or wasn't actually committed by the abettor, an abettor can be separately prosecuted for abetment. The punishment for abettors is same as that for the principal offenders in many cases. Abetment is commonly used in economic offences.
To seek anticipatory bail in NDPS cases, is much stricter under Section 37 NDPS Act. The court has to be satisfied that there are reasonable grounds to believe that the accused is not guilty of such offence and that he is not likely to commit any offence while on bail.
