Yes. Under Sections 34-44 BNS, every person has a right of private defence against unlawful personal violence, theft, robbery, mischief or criminal trespass. Cheque dishonour is a crime under Section 138 NI Act. It is punishable with imprisonment for up to 2 years or fine up to twice the cheque amount, or both. Complainant must issue statutory notice within 30 days of receiving memo from bank. Drawer has 15 days of receiving notice to pay the cheque amount. Only after this, complaint can be filed.
Police have to file chargesheet in requisite time limit. Time limit is ordinarily 60 days for offences punishable with up to 10 years imprisonment and 90 days for more serious offences. This is an updated guideline issued by Supreme Court but time limit varies based on nature of offences. Failure to file chargesheet attracts default bail to accused.
