How Can a Supreme Court Advocate Help in Filing an SLP Against a High Court Order? & Across India

Learn how a Supreme Court advocate can help assess, draft and file an SLP against a High Court order, including grounds, documents, limitation and interim relief.

How Can a Supreme Court Advocate Help in Filing an SLP Against a High Court Order?

A High Court judgment or order may thrust a long-pending litigation cabin onto a new ledge. It may have ramifications on a person’s land or career/business, freedom, family and finances. When that happens, the natural question that arises is whether the order is challengeable in the Supreme Court. If yes, then should a Special Leave Petition be filed?

Filing an SLP is not a matter of right like second appeal. Article 136 of the Constitution grants the Supreme Court the discretionary power to grant special leave to appeal from any judgment, decree, determination, sentence or order in any cause or matter passed or made by any court or tribunal in India. However, just because the Supreme Court can exercise its discretion to grant an appeal does not mean that it would be prudent to exercise that discretion.

Whether to file a SLP calls for strategy. One needs to consider the facts of the case, the law involved, the procedural stage of the case, and the nature of the challenge desired by the client before deciding how best to proceed.

For most people living in Delhi, Ghaziabad, Noida, Gurugram, Lucknow, Mumbai, Bengaluru or anywhere else in India, the problem is not hiring a lawyer. The problem is knowing what to present to the Apex Court and what not to.

At Advocate BK Singh & Associates, Advocates we begin with the order being challenged, the record of proceedings and relief sought by our clients. Every case is different. While one petition that merely summarizes all arguments made at the lower courts will not help the client, a well drafted SLP would highlight why the Apex Court should exercise its discretion.

When Does an SLP Matter after a High Court Order in 2026?

When a High Court order negatively impacts your rights and there is no other preferable or effective remedy that is expected to be exhausted under normal circumstances, an SLP might become applicable to your situation. In this regard, the Supreme Court has held that Article 136 is a special discretionary jurisdiction and not a right of appeal available in every case.

In practical terms, for clients from Delhi NCR and elsewhere in India, a lot may depend on the High Court order. The case could be related to criminal matter, property or civil dispute, commercial dispute, service matter, regulatory decision or MAT/matrimonial matter or order passed by a tribunal.

Your Supreme Court lawyer can help you understand if the intended challenge actually falls under the Supreme Court’s purview, if an SLP is maintainable against the High Court order, what grounds need to be highlighted and if interim relief needs to be requested. It becomes particularly beneficial to conduct this analysis early on, if an unfavorable order could lead to execution, possession being handed over to another party, arrest or arrest-like consequences, recovery actions, termination of employment or services, demolition, attachment, or any other action that could lead to irreparable problems.

Quick Facts

  1. An SLP is preferred under Article 136 of the Constitution of India.
  2. Article 136 accords discretionary powers to the Supreme Court; SLP is not an appeal of right.
  3. Supreme Court Rules: Special Leave Petitions.
  4. The form of SLP can be found on the website of the Court. It’s called Form 28.
  5. An SLP is to be founded on the pleadings and the record of the proceedings below. Additional grounds may be raised subject to the applicable Rules and the leave of the Court.
  6. Delay and limitation should be dealt with at the very outset instead of dealing with them after starting the drafting of the SLP.
  7. Grant of special leave and success in the appeal thereafter are two different stages.

What Is a Special Leave Petition?

A Special Leave Petition is a petition requesting the Supreme Court to avail its discretionary jurisdiction under Article 136 and accord special leave to appeal against any judgment, decree, determination, sentence or order in any cause or matter passed by any court or tribunal.

Notice how the wording says “asking” the Supreme Court to grant leave. An SLP first asks the Supreme Court to grant leave to proceed. If leave is granted, then the matter moves into appellate territory. The Supreme Court recently reiterated that Article 136 jurisdiction is split into two stages.

An SLP is therefore not simply a continuation of the High Court proceeding. The petitioner must articulate, at the outset, what legal /procedural ground they are invoking for Supreme Court intervention.

Firstly Article 136 of the Constitution of India. It gives the Supreme Court wide but discretionary power to grant special leave to appeal from any judgment, decree, determination, sentence or order in any cause or matter passed or made by any court or tribunal in the territory of India.

On the procedural side, the Supreme Court Rules apply, including the provisions governing Special Leave Petitions. On its Rules page, the Supreme Court presently links to the Supreme Court Rules, 2013 , along with subsequent amendments.

Before moving forward, one practical point to note. The Court has stated that an SLP is typically restricted to the pleadings before the court or tribunal from which the order being appealed originated. Additional grounds can be allowed by the Court if the case warrants it.

This is why the original record is important. You can’t just tack on an argument because you think it’s helpful after the High Court order is issued. You have to work with what was pleaded, looked at what evidence was put on record and most importantly what was decided by the High Court.

Who May Need Help With an SLP?

  • An Individual who has been negatively impacted by the order or judgment of the High Court.
  • An Individual where a Company or business will suffer significant detriment from an appellate ruling.
  • Family members who have been party to Property/Marriage/Succession proceedings.
  • The Accused or prosecution where a party has received an unfavorable criminal order.
  • An Employee or Employer where a service or employment related judgment has been made.
  • A party who has received an order from a suitable Tribunal or another order fitting the criteria above.
  • Anyone who can establish that the High Court has passed an order without considering a vital point of law or material procedural protection.

If your order is adverse, this does not automatically mean you can approach the Supreme Court. There may be other statutory remedies available. Rights of review and the nature of the order will also be relevant.

Documents to Be Ready Before Filing an SLP?

Have the Client organise all of the documents beforehand, unless there is a compelling reason. The entire record of the litigation should normally be ready before the client requests that an advocate file the petition.

Typical Documents

  • Copy of the challenged High Court order certified or otherwise in proper form.
  • Previous orders passed by the High Court in the dispute.
  • Copies of the plaint and written statements/replies.
  • Any appeals, revisions, writ petitions or other proceedings initiated in the lower court.
  • Copies of important applications and affidavits.
  • Copies of all evidence and documentary exhibits filed during the trial.
  • Copy of written arguments submitted, if any.
  • Copies of notices and other correspondence relating to the dispute.
  • Copy of the case number, dates and current procedural posture.

Documents that can be used as evidence

Documents such as contracts/agreements, title deeds, service records, bank statements, official letters, medical or engineering reports, companies documents etc. Photographs and correspondence may also be helpful depending on the nature of the dispute.

Include both favorable and unfavorable documents. Only send Advocate BK Singh those documents that support your position. He will need to see both the good and bad parts of the trial court record to evaluate the merits of filing an SLP.

What Is the Usual SLP Process?

Whilst each case is different, and thus the precise process alters, the general preparation usually commences with an analysis of the High Court judgment as well as procedural history.

Next up is the determination of the remedy sought and limitation. Counsel then drafts the chronology, material facts and the proposed grounds.

This is followed by the drafting of the SLP, affidavit in support, annexures and any interim application/applicant being required to address delay /procedural hurdles.

The filing set is then vetted from an applicable Supreme Court procedure perspective. The Registry may draw defects that need to be addressed. Once it is placed in the correct stage, Court analyses if special leave is deserved.

Advocate BK Singh therefore does not just stuff words into a petition. The initial analysis can impact the entire filing strategy.

When to See a Supreme Court Advocate?

If:

  • A High Court has issued an order which seriously impacts your rights.
  • You need a statutory or constitutional remedy reviewed.
  • An important limitation period is impending.
  • The order will likely be enforced before the dispute can finally be determined.
  • The case involves significant financial, property/business, employment or liberty implications.
  • You feel the High Court erred in not recognizing a material legal point.
  • You are unsure if the correct remedy is an SLP, review, appeal or some other proceeding.

then seek advice sooner rather than later.

Note that just because you see a lawyer early, that does not necessarily mean that an SLP will be filed. It only means that you have the options evaluated before a potentially crucial window of opportunity closes.

How Can BK Singh Advocate Help You With an SLP?

BK Singh Advocate handles litigation and legal representation before the Supreme Court of India, High Courts and tribunals across India. Our Supreme Court High Court and Tribunal Litigation page includes a separate write-up on appellate/jurisdictional work which focusses on review of documents, limitation/maintainability issues, drafting and procedural requirements.

An SLP or Special Leave Petition is against the order of a High Court. In such cases, Advocate BK Singh can help you in going through the judgment/order being challenged (impugned judgment), reconstruct the case/procedural history, identify issues involved, sort out relevant documents and get the matter ready for filing in the required Supreme Court format.

Indian clients located in Delhi NCR or elsewhere can start by emailing the full order passed and a brief chronology. It isn’t about guaranteeing any result at this stage. It is about determining if seeking Supreme Court intervention is legal viable or makes practical sense.

FAQs

Q1. Can I file an SLP against every order passed by the High Court?

Ans. No. Article 136 grants discretionary powers to the Supreme Court. Whether an SLP lies in a matter depends on the nature of the order, the available remedies, legal grounds, procedural posture and facts of the case.

Q2. Is SLP the same as filing an appeal?

Ans. No. When filing an SLP you first pray the Supreme Court to exercise its discretion and grant you leave. Only after leave is granted does the matter move into the appeal stage. The two stages have been separately recognized by the Supreme Court in interpreting Article 136.

Q3. Can I file an SLP against an order passed by the High Court in a criminal matter?

Ans. An SLP can be filed against appropriate criminal orders. The nature of the order, available remedies under statute and the circumstances of the case must be reviewed to determine the proper course of action. Only upon reviewing the record can the correct avenue be advised.

Q4. What paperwork do I need to file an SLP?

Ans. This depends on the facts and nature of the matter. However, some common documents that may be required are the order you want challenged (impugned order), relevant pleadings filed in High Court, previous orders by the court, any supporting documents/reports, a chronology and any applications required by court rules. Form and procedure for SLP can be obtained on the Supreme Court's website.

Q5. I want to raise new arguments before the Supreme Court. Can I do that in an SLP?

Ans. The rule is that an SLP is limited to the pleadings that were made before the court or tribunal issuing the order challenged in the SLP. That is, unless the Supreme Court permits otherwise.

Q6. Is there a time limit to file an SLP?

Ans. There is no time limit under Article 136. But you should verify if there is any applicable limitation period under the law and procedural rules governing your case. If you file an SLP after the limitation period you may have to separately file an application seeking condonation of delay, if allowed.

Q7. How do I get an immediate stay of a High Court order?

Ans. First, there is nothing immediate about it. Secondly, no order is stayed automatically just because you file an SLP. You have to make a separate request for a stay to the court. Whether you should file such an application and what your chances of success are would depend on the facts of the case, the legal issues in the case, whether the matter is urgent and other circumstances. Advocate BK Singh can advise you on the same after reviewing your records.

Q8. Once I file an SLP does the order I want stayed get suspended automatically?

Ans. No. When you file an SLP you cannot expect the matter to be automatically suspended. If you want the order to be suspended you will have to make a separate application to the court and persuade the court that you deserve to be granted such relief.

Q9. Do I need to hire an Advocate-on-Record to make a Supreme Court filing?

Ans. Every Supreme Court filing is done through an Advocate-on-Record (“GOR”). If you intend to file an SLP, you will have to hire an advocate who is a GOR. Your counsel who plans to handle the case for you and appear in court during the proceedings will have to coordinate with the GOR and get him to file the SLP on your behalf in accordance with the rules and procedures set by the court.

Q10. Will my Supreme Court advocate assure me that my SLP will be accepted?

Ans. No lawyer can guarantee you that your SLP will be accepted by the court. Advocate BK Singh will review the record, advise you on your chances, identify possible grounds to argue, prepare the petition for filing and fight for you in court to seek relief, but he cannot control the decision of the judges.

Conclusions

An order of the High Court is not necessarily the final word in every litigation. However, an SLP should never be viewed as a matter of right – the next appellate step in the process.

Article 136 grants a discretionary power to the Supreme Court. The merit of a potential SLP therefore lies in the grounds for intervention, the record on paper, procedural requirements, limitation etcetera and the relief truly needed.

If you have received an unfavorable order from the High Court it is advisable to first preserve the entire record and seek an urgent evaluation. Advocate BK Singh can assist you in understanding whether filing an SLP is the right option, what the key issues are and what procedure would follow thereafter.

Based out of Delhi, for clients located in Delhi NCR, Ghaziabad, Noida, Gurugram and other cities in India, a meticulous document-based review can help you understand your position far better than guesswork on Supreme Court appeals.
