Loan default gives a lender the right to recover his money by all legal means. This does not give a recovery agent the right to harass a borrower with impunity. Banks and other financial institutions regulated by the RBI are liable for the acts of recovery agents in their employ. In fact RBI guidelines forbid agents from using coercion, or resorting to public humiliation, invasion of privacy, threatening calls and abusive recovery calls beyond specified hours.

For borrowers struggling with debt, it can be difficult to know when genuine recovery efforts end and harassment begins. The bank has a right to demand its money. They can send notices. They can start contractually permitted, or statutory debt recovery procedures. Just because they are causing you inconvenience or stress does not necessarily mean they are harassing you.

Harassment of a borrower crosses the line when efforts to collect the debt become abusive, deceptive, humiliating or threatening to your physical well being.

How Can You Respond to Recovery Agent Harassment?

File a complaint without any attachments

Note down the agent’s name & number, recovery agency name & lender name, date & approximate time of the calls. Save all WhatsApp conversations, SMS forwards, emails, call logs, notices and recordings that are available to you legally.

Confirm whether the person has been deputed by the lender. Ask for an ID proof and talk to the lender on their registered number rather than trusting your lender on what the recovery agent says.

Be specific about the misconduct in writing. Avoid comments such as ā€œyour agent is troubling meā€. Record dates and times of calls received, threats made, visits to your office, contacts to your family members or privacy being breached.

Once drafted, send the complaint to the bank/NBFC’s registered grievance-redressal system as BK Singh recommends so that there is proof of delivery.

Documents to be preserved:-

  • Loan agreement, sanction letter & account no.
  • Latest statement of account and demand note for the overdue amount.
  • Identity details of the recovery-agent (name, id number) if known.
  • Call records showing date and time dialed.
  • WhatsApp, SMS or social-media conversations.
  • Emails sent by the recovery agents/lender.
  • Recordings. Any other evidence you have lawfully received.
  • Dates they visited their office/home.
  • Family members, colleagues or third parties they spoke to.

Ans.No. Your obligation to repay the loan is separate from the behaviour of the recovery agent.

7. Can the recovery agents visit my home/office?

Ans.The recovery agents have the right to visit you by serving a lawful visit. However, they cannot threaten you with violence, use force on you or humiliate you.

8. What proof should I keep?

Ans.You should keep a record of any calls/messages/emails (if any), audio/video recordings (as lawfully available to you), any notices served, name/s and employee ID of agents visiting you and a copy of your complaint along with the acknowledgement received.

9. Can the recovery agents threaten me with police arrest if I don't repay the loan?

Ans.No. Agents should not automatically threaten you with arrest by the police if you fail to pay the loan amount.

10. Should I consult a lawyer?

Ans.You should consult a lawyer if you experience serious threats of harm to yourself or family members, experience physical intimidation, receive SARFAESI notices, court proceedings are initiated against you or in cases of persistent harassment.
