Frequently Asked Questions

Family Lawyer -25 Questions Answered

Clear answers to frequently asked questions about divorce, maintenance, child custody, domestic violence and family-law proceedings in India by Advocate BK Singh at LEGAL365.

Ans. Consult a family lawyer when you are considering separation or divorce, have received a court notice, face domestic violence, need maintenance, have a child-custody or visitation dispute, or need advice about marriage registration, matrimonial property, stridhan, or an NRI marriage. Early advice helps identify the applicable personal law, correct court, limitation or response deadlines, necessary documents, and realistic legal options.
Ans. The applicable law depends on how the marriage was solemnised or registered, the parties’ religion or personal law, and the relief requested. Matters may arise under the Hindu Marriage Act, Special Marriage Act, Divorce Act, Parsi Marriage and Divorce Act, Muslim personal law, or other statutes. Maintenance, domestic violence, custody, and criminal proceedings may also involve separate laws, so the marriage documents should be reviewed first.
Ans. Bring the marriage certificate or wedding proof, identity and address documents, children’s birth certificates, income records, bank statements, tax returns, property and loan papers, medical records where relevant, previous complaints or court orders, notices, messages, emails, photographs, and details of pending cases. Do not alter or unlawfully access evidence. A lawyer can identify which documents are relevant after understanding the dispute.
Ans. Mutual consent divorce is a joint process in which both spouses agree to dissolve the marriage and settle issues such as maintenance, child custody, visitation, property, stridhan, pending cases, and other claims. The statutory conditions and procedure depend on the law governing the marriage. Consent must continue through the required stage, and the settlement should be carefully drafted before statements are made in court.
Ans. A contested divorce is filed by one spouse when the other does not agree to divorce or disputes the grounds or relief. The petitioner must establish a legally recognised ground under the applicable matrimonial law, such as cruelty, adultery, desertion, conversion, or another statutory ground where available. The respondent may file a defence and related claims. Evidence, pleadings, jurisdiction, and procedure are important.
Ans. Under some matrimonial laws, a divorce petition ordinarily cannot be presented within the first year of marriage. A court may permit an earlier petition in exceptional circumstances recognised by the applicable statute, such as exceptional hardship or depravity. The rule and exceptions depend on the law governing the marriage. Judicial separation, protection orders, maintenance, custody, or other remedies may still be available where appropriate.
Ans. Jurisdiction is not based only on a spouse’s preferred hometown. Depending on the applicable matrimonial law, a petition may be filed where the marriage was solemnised, where the respondent resides, where the parties last resided together, or in certain circumstances where the wife resides. The precise rule can vary, and facts such as foreign residence or multiple addresses may create additional issues.
Ans. Adultery may be a ground for divorce under applicable matrimonial law, but the spouse alleging it must prove the claim through legally admissible evidence and surrounding circumstances. Mere suspicion, accusations, or illegally obtained material may be insufficient or create separate legal problems. Adultery should also not be confused with cruelty or financial misconduct, although the same facts may sometimes support more than one pleaded ground.
Ans. Judicial separation allows spouses to live separately without immediately dissolving the marriage. The marital status continues, so neither spouse can remarry while the decree remains in force. Divorce legally ends the marriage after a decree becomes effective. Judicial separation may be considered where reconciliation remains possible or where a spouse seeks formal separation before deciding whether to pursue divorce.
Ans. Maintenance depends on the applicable law, the claimant’s income and needs, the other spouse’s means and liabilities, the standard of living, dependants, conduct where legally relevant, and other facts. Interim maintenance may be sought while proceedings are pending, while permanent alimony may be considered at or after final relief. Maintenance is not automatic, and courts examine financial disclosure and the circumstances of both parties.
Ans. No single answer applies to every maintenance proceeding. The effect of alleged adultery or other conduct depends on the statute invoked, the wording of that law, the quality of evidence, and the facts of the case. A mere accusation does not automatically end maintenance. The court may also examine income, dependency, separation circumstances, and other statutory factors before granting, reducing, refusing, or modifying relief.
Ans. India does not have a general rule that every asset acquired during marriage is automatically divided equally on divorce. Ownership usually depends on title, contribution, applicable personal law, settlement terms, trust or beneficial-interest claims, and specific statutory remedies. Jointly owned property may require partition or settlement. Maintenance and residence rights are separate issues and do not automatically transfer ownership.
Ans. Stridhan generally includes property, money, jewellery, gifts, and other assets legally belonging to a woman, depending on how and when they were received. It is distinct from jointly owned property or items belonging to another person. To seek recovery, preserve purchase records, wedding lists, photographs, bank records, messages, witness details, and any acknowledgment of possession. The appropriate civil or criminal remedy depends on the facts.
Ans. The child’s welfare and best interests are the central considerations. Courts may examine the child’s age, safety, health, education, emotional needs, existing care arrangements, each parent’s capacity, stability, conduct affecting the child, and the child’s preference where age and maturity make it appropriate. Custody is not automatically granted to either parent solely because of gender or income.
Ans. A parent who does not have primary custody may seek visitation, access, holiday contact, video calls, or another parenting arrangement consistent with the child’s welfare. The court can structure timings, locations, supervision, travel conditions, and communication. Access may be restricted where credible safety concerns exist. Parents should follow court orders and avoid using the child to pressure the other parent.
Ans. Yes, certain family-court orders may be modified when there is a material change in circumstances or when modification is required for the child’s welfare or to reflect changed financial conditions. Examples may include relocation, schooling needs, health issues, non-compliance, altered income, or safety concerns. A party should apply to the competent court instead of unilaterally ignoring the existing order.
Ans. Where there is immediate danger, contact the police or emergency services and move to a safe place where possible. Depending on the facts, a woman may seek protection, residence, monetary, custody, compensation, and interim orders under the Protection of Women from Domestic Violence Act, along with other civil or criminal remedies. Preserve medical records, messages, photographs, complaints, witness details, and copies of important documents.
Ans. Family Courts are designed to encourage conciliation and settlement where appropriate, and courts may refer suitable disputes to mediation or counselling. A settlement is voluntary and should not be accepted under pressure. Mediation can address divorce terms, maintenance, custody, visitation, property, and connected cases, but it may be unsuitable where safety, coercion, concealment, or urgent protective relief is involved.
Ans. Collect lawfully available records such as tax returns, salary documents, company information, bank entries already accessible to you, property records, loan applications, lifestyle evidence, and previous financial disclosures. Do not hack accounts, impersonate anyone, or unlawfully obtain private data. A court may direct disclosure or production of relevant records. The required application depends on whether the issue concerns maintenance, property, or enforcement.
Ans. Marriage registration provides official evidence of the marriage and is important for passports, visas, insurance, inheritance, banking, maintenance, and matrimonial proceedings. The procedure depends on the law under which the marriage was solemnised or registered and the rules of the state or union territory. Absence of a certificate does not always mean that no valid marriage exists, but it can create evidentiary difficulties.
Ans. NRI family disputes may involve service of notice abroad, foreign addresses, travel restrictions, immigration status, overseas income and assets, child relocation, and recognition of foreign judgments. A foreign divorce decree is not automatically conclusive in every Indian proceeding. The court’s jurisdiction, applicable law, opportunity to contest, grounds of divorce, and procedural fairness must be examined before relying on it in India.
Ans. An ex parte order may be passed when a spouse does not appear despite legally sufficient service or fails to participate in the proceeding. The affected spouse may be able to seek setting aside or recall by explaining the absence and acting within the applicable limitation period. An appeal may also be available in some cases. Ignoring summons is risky, so the complete order and service record should be reviewed immediately.
Ans. Many judgments and specified orders may be appealed within the prescribed period, but the right and forum depend on the governing statute and nature of the order. Consent-based decrees and settlements may have narrower grounds of challenge, such as lack of genuine consent, fraud, jurisdictional error, or procedural illegality. Filing an appeal does not automatically stay the order, so interim protection may need to be requested.
Ans. There is no reliable fixed timeline or universal fee. Duration depends on whether the matter is mutual or contested, service of notice, evidence, interim applications, settlement, court workload, and appeals. Fees depend on drafting, hearings, urgency, document volume, connected proceedings, and complexity. The scope of work, professional fee, court expenses, and payment stages should be discussed before engagement.
Ans. You can call or WhatsApp LEGAL365 at +91-935-521-5699 or email info@legal365.co.in. Share the law under which the marriage was registered if known, marriage date and place, current residences, children’s details, pending cases, notices or orders, and urgent deadlines. Advocate BK Singh can review the available documents, explain possible legal routes, and discuss the scope of representation.
