Ans. The applicable law depends on how the marriage was solemnised or registered, the parties’ religion or personal law, and the relief requested. Proceedings may arise under the Hindu Marriage Act, Special Marriage Act, Divorce Act, Parsi Marriage and Divorce Act, Muslim personal law, or another statute. Maintenance, domestic violence, custody, and criminal proceedings may also involve separate laws.
Ans. Bring the marriage certificate or wedding proof, identity and address documents, children’s birth certificates, income records, bank statements, tax returns, property and loan papers, medical records where relevant, notices, complaints, previous court orders, messages, emails, photographs, and details of pending cases. Do not alter or unlawfully access evidence. A lawyer can identify what is relevant after reviewing the dispute.
Ans. Mutual consent divorce is a joint process in which both spouses agree to end the marriage and settle issues such as maintenance, child custody, visitation, property, stridhan, pending cases, and other claims. The statutory conditions and procedure depend on the law governing the marriage. Consent must continue through the required stage, and the settlement should be carefully drafted before statements are made in court.
Ans. A contested divorce is filed by one spouse when the other does not agree to divorce or disputes the grounds or relief. The petitioner must establish a legally recognised ground under the applicable matrimonial law, such as cruelty, adultery, desertion, conversion, or another statutory ground where available. The respondent may file a defence and related claims. Evidence, pleadings, jurisdiction, and procedure are important.
Ans. Under some matrimonial laws, a divorce petition ordinarily cannot be presented within the first year of marriage. A court may permit an earlier petition in exceptional circumstances recognised by the applicable statute. The rule and exceptions depend on the law governing the marriage. Judicial separation, protection orders, maintenance, custody, or other remedies may still be available where appropriate.
Ans. Jurisdiction is not based only on a spouse’s preferred hometown. Depending on the applicable law, a petition may be filed where the marriage was solemnised, where the respondent resides, where the parties last resided together, or in certain circumstances where the wife resides. Ans. Stridhan generally includes property, money, jewellery, gifts, and other assets legally belonging to a woman, depending on how and when they were received. It is distinct from jointly owned property or items belonging to another person. Preserve purchase records, wedding lists, photographs, bank records, messages, witness details, and acknowledgments of possession. The appropriate civil or criminal remedy depends on the facts.

Courts may examine the child’s age, safety, health, education, emotional needs, existing care arrangements, each parent’s capacity, stability, conduct affecting the child, and the child’s preference where age and maturity make it appropriate.
